16 CFR § 1450.3

Incorporation by Reference.

(a) Except as provided in paragraph (b) of this section, each swimming pool or spa drain cover manufactured, distributed, or entered into commerce in the United States shall conform to the entrapment protection standards of ANSI/APSP/ICC–16 2017, American National Standard for Suction Outlet Fitting Assemblies (SOFA) for Use in Pools, Spas and Hot Tubs, approved on August 18, 2017. The Director of the Federal Register approves this incorporation by reference in accordance with 5 U.S.C. 552(a) and 1 CFR part 51. What we inspect

Drain covers must conform to ANSI/APSP/ICC-16 2017 (SOFA)

We check that drain covers are certified to the current national safety standard for suction outlet fittings.

Must be: Drain covers must meet the ANSI/APSP/ICC-16 2017 safety standard for suction outlet fitting assemblies.

If it fails: Replace outdated or uncertified drain covers with ones stamped as meeting the ANSI/APSP/ICC-16 2017 standard.

What we inspect

Drain covers must be marked with a manufacturer-stamped service life

We check the drain cover for a manufacturer stamp showing its rated service life, and confirm it hasn't expired.

Must be: The drain cover's stamped expiration date must not have passed.

If it fails: Replace any drain cover that's unmarked, unreadable, or past its stamped service-life date.

(b) The CPSC standard does not require compliance with the following provisions:
(1) Section 1.1.3 of ANSI/APSP/ICC–16 2017.
(2) Sections 1.3.3.1 through 1.3.3.2 of ANSP/APSP/ICC–16 2017.
(3) Section 3.2.4 of ANSI/APSP/ICC–16 2017.
(4) Section 3.5.1 of ANSI/APSP/ICC–16 2017.
(5) Sections 3.6.1 through 3.6.4.3 of ANSI/APSP/ICC–16 2017.
(6) Section 3.7 of ANSI/APSP/ICC–16 2017.
(7) Section 9.4 of ANSI/APSP/ICC–16 2017.
