North Carolina State Rules
OSFM appeal decision - AV105 barrier requirements
Safety Barriers, Gates & Alarms
What we inspect
No fixed max distance from pool edge for barrier placement in AV105
We note how far your pool barrier sits from the water's edge.
Must be: There's no statewide maximum distance a barrier can be from the pool; the code doesn't limit how far back a fence can be placed.
OSFM Appeal Decision (Feb. 9, 2025), Conclusions 1
What we inspect
Local governments may set stricter barrier-placement distance rules via a UDO
We check whether your local government has its own rule limiting how far the barrier can be from the pool.
Must be: State code sets no distance limit, but your city or county can set its own maximum distance through a local development ordinance.

Plan Review & Permitting
What we inspect
Permit may be revoked if built barrier substantially deviates from plans
We compare the barrier as built to what was shown on the approved permit plans.
Must be: The built barrier must match the approved permit; a major mismatch can lead the local government to revoke the permit.
If it fails: Work with your contractor and the local building office to update permit records to match what was actually built.
